False Allegations of Child Neglect

I got an email this weekend from a reader who had just learned about the false and secret allegations of child neglect against conservative activist Chuck Muth in Carson City. He pointed me to attorney Gregory Hession in Massachusetts who has done a painstaking job of documenting unfair and unconstitutional actions by child welfare authorities in his home state.     What can be done to make Child and Family Services obey the same due process rules and Constitutional limitations as law enforcement investigations into crimes such as murder or drug offences?

    This needs to be monitored.
    And Child and Family Services need to be held accountable for fraudulent charges.

    The problem is that every time a legislator proposes legislation to reel in the child welfare gestapo, they are labeled by the other party as “children haters”, and “in favor of child abuse”, etc.

    This is similar to the reason there are 13 and 14 year olds registered as sex offenders (for life) for (*gasp*) the crime of indecently soliciting a child under the age of 16! (LOL). Go figure. Legislators can’t reel in these statutes because then they are labeled soft on crime, etc.

    That site is an extension of the outrage in “No Crueler Tyrannies.” It is truly turning into a police state with no due process where you are guilty until proven innocent. Unreal.

    What is needed in Nevada to avoid all the usage of “Anonymous Sources” for a myriad of state, county or city investigations of citizens, businesses, & or organizations. In this state anyone can make “Anonymous Charges against anyone or any entity” with total immunity from liability for those actions.

    90% + of investigation time in just the Department of Insurance is spent investigating “Anonymous Charges” from one insurace agent or agency trying to screw another competitor by using the state of Nevada to harass their competitor with “ANONYMOUS complaints.

    The solution to all this CONSTITUTIONAL ABUSE. Pass a law in Nevada that mandates DUE PROCESS under the US Constitution in all matters in NEVADA period. NO EXCEPTIONS In addition make the anonymous complainers LIABLE for administrative costs, attorney fees and fines for filing any FALSE ALLEGATIONS! Especially we should stop giving PUBLIC EMPLOYEES A PASS ON THIS CATEGORY OF OVERSIGHT!

    May the combined efforts of all of us help the millions of parents and children who need help right now. Liberty contains the fundamental constitutional rights of parenthood. Liberty is found well imbedded within the constitutional case law of “Privileges and / or Immunity Clause’s”.

    “The statist notion that governmental power should supersede parental authority in [497 U.S. 417, 447] all cases because some parents abuse and neglect children is repugnant to American tradition.” Parham, 442

    Compare that US Supreme Court quote from PARHAM v. J. R., 442 U.S. 584 (1979) with the 3rd law on the books in this State of Nevada law.

    “NRS 1.030 Application of common law in courts. The common law of England, so far as it is not repugnant to or in conflict with the Constitution and laws of the United States, or the Constitution and laws of this State, shall be the rule of decision in all the courts of this State.”

    Even if we succeed in hobbling abusive governmental agencies with due process, disgusting individuals such as nevhusker (see comment #5) will just use the media to spew his vile vengeance in other ways…..media etc.. He is an insect, feeding on carnage and death existing in the shadows of existence.
